What Qualifies as Domestic Violence?

According to the Office of Violence Against Women (OVW), “domestic violence is a pattern of abusive behavior in any relationship that is used by one partner to gain or maintain power and control over another intimate partner.”

When people hear the term “domestic abuse,” they immediately think of physical violence. And, while this is definitely one type of behavior that falls under the abuse umbrella, it is not the only action that qualifies.  Other types of abuse include emotional, psychological, financial and sexual. The absence of bruises does not mean there is no abuse. The impact is often physically invisible, but very real.

For example, if your partner forces you to have sex, verbally attacks you, or isolates you from your friends and family, you are an abuse victim.  Additionally, individuals who force dependence by preventing their partner from working or earning a living are also abusive.  The range of behaviors is diverse, but all  have a devastating impact. Protection Orders Help Control Your Situation

Helping  ensure your safety is the most important step we take. While we always look forward, we must deal with the present immediately. Protection orders, also referred to as restraining orders, can be obtained to keep your partner from coming near you or even communicating with you.

Colorado law provides three types of protection orders: emergency, temporary, and permanent. Emergency protection orders are usually the result of police requests and are issued by a judge. Their purpose is to protect a victim for a short period of time, until the court can meet to hear their case (often within a day).  Similar to emergency orders are temporary protection orders; the difference is these last a bit longer. They are issued by a judge in an initial hearing and are designed to provide victims protection until their case comes to court.

If a judge believes you are in danger after hearing your case, they may issue a permanent protection order. This long-term decision impacts your partner’s ability to contact you in person, via telephone, through social media,  or even by email/mail. It may also identify certain locations to be avoided.

After that, a second hearing will be scheduled providing your partner the opportunity to argue against its issuance.
